Is it safe to use AI with customer data in the US and Canada?

A practical, honest look at privacy when small businesses put customer information into AI tools.

The honest answer

It depends on the tool, the data, and how you use it. AI is not automatically unsafe, and it is not automatically safe. What matters is where the data goes, who can see it, and whether the tool is used for training.

The three questions to ask

  1. Where does the data go? Some tools process and discard it. Others store it. Others train on it. Know which.
  2. Who can access it? Consumer tools are not built for confidential business data. Business/enterprise tiers usually add protections.
  3. What are you allowed to put in? Personal health information, financial records, and identity documents deserve extra care.

United States

There is no single federal privacy law covering all small businesses, but sector rules matter — for example HIPAA for health information, and the FTC Act for deceptive claims. State laws such as California's CCPA/CPRA give consumers rights over their data. Where health data is involved, a Business Associate Agreement (BAA) may be required with vendors.

Canada

PIPEDA applies to most private-sector organizations, and Quebec's Law 25 adds requirements if you serve Quebec. Consent, limiting collection, and safeguarding data are central. For health information, provincial rules such as Ontario's PHIPA apply.

A practical policy that works

  • Use business tiers of AI tools, not consumer ones, for anything involving customers.
  • Never paste health, financial, or identity data into a tool that is not set up for it.
  • Keep data inside your own accounts where possible.
  • Write down what staff are and are not allowed to put into AI tools.
  • Sign data agreements where they apply, and review anything touching regulated data with qualified advice.

What we do

We build with privacy in mind: restricted access, data kept in your accounts, and no unsupported compliance claims. If a setup cannot be done safely, we say so. “Privacy-aware” is a standard we can stand behind; “certified” is a claim we will not make unless it is verified.
